June 13, 2014. In today’s Federal Register, the Department of Health and Human Services (HHS) published its Semiannual Regulatory Agenda of “forthcoming regulatory actions.” Included under Final Rule Stage actions of the Centers for Medicare & Medicaid Services (CMS) was “Adoption of Operating Rules for HIPAA Transactions (CMS-0036-IFC).” Here is the abstract of this action, which can be found on page 34064 of the Semiannual Regulatory Agenda at http://www.gpo.gov/fdsys/pkg/FR-2014-06-13/pdf/2014-13125.pdf:
“Under the Affordable Care Act, this interim final rule adopts operating rules for HIPAA transactions for health care claims or equivalent encounter information, enrollment and disenrollment of a health plan, health plan premium payments, and referral certification and authorization.”
According to the timetable, HHS is expected to publish this action in the Federal Register in March 2015. Prior to its publication, HHS will submit the action to the Office of Management and Budget (OMB) where it will undergo an Executive Office of the President (EO) 12866 Regulatory Review by the Office of Management and Budget (OMB).
